Welcome to Thamaris. These Terms of Service ("Terms") apply to your use of our website thamaris.com and any purchase you make from us. By using our website or placing an order, you agree to these Terms. Please read them carefully.

Throughout these Terms, "we", "us" and "our" refer to Thamaris, and "you" refers to anyone using our website or buying from us.

Your rights under Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any rights you have under the Australian Consumer Law or any other law that cannot be excluded. Where these Terms seem to conflict with those rights, your legal rights prevail.

Using our website

By using our website, you confirm that you are at least 18 years old, or that you're using it with the involvement of a parent or guardian. You agree not to use our website for any unlawful purpose, to interfere with its security or operation, or to copy, scrape or misuse its content.

Products and descriptions

We do our best to describe and display our products accurately. However:

  • colours may appear slightly different depending on your screen
  • measurements and weights are approximate and may vary slightly
  • product packaging may differ from the images shown

If a product you receive is significantly different from its description, please see our Refund Policy.

Prices and payment

All prices are in Australian dollars (AUD) and include GST where applicable. Shipping costs are shown at checkout before you pay.

We may change our prices at any time, but changes won't affect orders you've already placed. If a product is listed at an incorrect price due to an obvious error, we may cancel the order and give you a full refund, even after it has been confirmed.

Payment is due in full at the time of purchase and is processed securely by our payment providers. We do not store your full card details.

Orders

Your order is an offer to buy from us. We'll send you an order confirmation email, and the contract is formed when we dispatch your order.

We may refuse or cancel an order, for example if a product is out of stock, there's a pricing or description error, or we suspect fraud. If we cancel your order after you've paid, we'll give you a full refund.

Shipping and delivery

Delivery times and costs are explained in our Shipping Policy. Delivery estimates are a guide only, and we're not responsible for delays caused by carriers or events outside our control. Your rights under Australian Consumer Law still apply.

Refunds

Refunds are handled in line with our Refund Policy. We don't offer refunds or exchanges for change of mind, but this doesn't affect your rights if a product is faulty, damaged, incorrect or not as described.

Safe use of our products

Our products are designed for general fitness, yoga and Pilates. Please:

  • read all product information and instructions before use
  • check products for wear, tears or damage before each use, and stop using them if damaged
  • use products only for their intended purpose
  • keep products away from young children and pets
  • note that some products contain natural latex and are not suitable for people with a latex allergy

Our website content is for general information only and is not medical or professional advice. If you're pregnant, recovering from an injury, or have a medical condition, please talk to a doctor or qualified health professional before starting any new exercise.

Limitation of liability

To the extent permitted by law, including the Australian Consumer Law, we are not liable for any indirect or consequential loss arising from your use of our website or products, or for loss or injury caused by misuse, improper use or failure to follow product instructions.

Where our liability can't be excluded but can be limited, our liability is limited, at our option, to replacing the goods, supplying equivalent goods, or refunding the price paid.

Discount codes and promotions

Discount codes and promotions are subject to the conditions shown with them, can't be exchanged for cash, and may not be combined with other offers unless stated. We may end or change a promotion at any time, but this won't affect orders already placed.

Reviews and content you submit

If you submit a review, photo or comment, you confirm it's your own honest opinion and doesn't contain anything unlawful, offensive or misleading. You give us permission to display it on our website and social media. We may remove content at our discretion.

Intellectual property

All content on our website, including text, graphics, logos and our brand name, belongs to us or our licensors. You may not copy, reproduce or use it for commercial purposes without our written permission.

Third-party links

Our website may include links to third-party websites. We're not responsible for their content, products or privacy practices.
